FEDERAL COURT CASES:

  • Griswold v. Connecticut:

    • Citation: 381 U.S. 479 (1965).
    • Holding: There is an unwritten constitutional right of privacy to exist in the penumbra of specific guarantees of the Bill of Rights "formed by emanations from those guarantees that help give them life and substance." This right is broad enough to encompass a woman's decision to terminate pregnancy under certain conditions. This right was later extended to end-of-life situations.
  • APPEAL FROM THE SUPREME COURT OF ERRORS OF CONNECTICUT No. 496 Argued: March 29-30, 1965 --- Decided: June 7, 1965
  • Halderman v. Pennhurst State School & Hospital:

    • Citation: 446 F. Supp. 1295 (E.D. PA, 1997) re surrogate decision-making for mentally handicapped institutional residents.
